Using this website
This website is operated by NovaPoint Consulting, LLC (“NovaPoint”, “we”, “us”). By using it you accept these terms. If you do not accept them, please do not use the site.
How information is handled is set out separately in our Privacy Policy, which forms part of these terms.
What this website is
This site describes what NovaPoint does, the kinds of problems we work on, and how an engagement usually runs. It is written for a general business audience.
Nothing here is advice for your situation. Every business differs, and what is sensible for one is wrong for another. Do not act, or decide not to act, on the basis of a page on this site without talking to someone — us or anyone else — who knows the specifics. Nothing on this site is legal, tax, accounting, financial or regulatory advice.
Contacting us and booking a call
Sending a message through the form, emailing or calling us, or booking a complimentary discovery call, does not create a consulting engagement or a client relationship, and it does not oblige either of us to anything. It starts a conversation.
A discovery call is a conversation about whether there is something here worth doing. It is not a deliverable, an assessment, an audit or a recommendation, and no work is being performed for you during it. We may decline to take on a piece of work, and you are free to walk away at any point before an agreement is signed.
Please do not send us confidential or commercially sensitive information before the arrangement for handling it is in place. If something needs protecting, tell us and we will sort out the right agreement first.
Paid work is governed separately
Any paid engagement with NovaPoint is governed by the written agreement for that work — a proposal, a statement of work, a services agreement, or another written contract signed by both sides. That agreement sets the scope, fees, timing, responsibilities, confidentiality, intellectual property and liability for the work.
These website terms do not create, replace, vary or limit any such agreement. Where these terms and a signed engagement agreement differ, the engagement agreement controls for that work.
Our content
The text, layout, diagrams, structure and design of this site, and the NovaPoint name and logo, belong to NovaPoint or its licensors. You may read the site, print pages for your own reference, and link to it.
Without our written permission, please do not republish our content, present it as your own, sell it, incorporate it into a product or service of your own, or extract it systematically by automated means.
Acceptable use
- Do not attempt to gain unauthorised access to the site, its endpoints or anything connected to it, and do not probe or test it for weaknesses without our written permission.
- Do not interfere with the site or place an unreasonable load on it, including through automated submissions to the form.
- Do not submit false information, someone else’s personal information without their permission, or anything unlawful, abusive or malicious.
- Do not use the form or our published contact details to send unsolicited commercial messages.
We may block access, or decline to respond, where any of this happens.
Other services and links
Parts of this site rely on services run by other organisations — notably Google’s appointment-scheduling page behind the booking button. Where you use one of those, that organisation’s own terms and privacy practices govern it. We also link to a small number of pages we do not control. We are not responsible for the content, availability or practices of any of them.
Availability and changes
We do not promise that this site will be available without interruption, that it will be free of errors, or that any particular page will stay where it is. We may change, move or remove content, and we may take the site down, at any time and without notice.
Disclaimer
To the fullest extent the law allows, this website and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the information here is complete, current or accurate for your circumstances, and you rely on it at your own risk.
Limitation of liability
To the fullest extent the law allows, NovaPoint is not liable for any indirect, incidental, special or consequential loss, or for lost profits, lost revenue, lost data or business interruption, arising out of your use of, or inability to use, this website.
This section is about the website only. Liability for paid work is dealt with in the agreement for that work. Nothing here excludes or limits any liability that cannot lawfully be excluded or limited.
Governing law
These terms, and any dispute arising out of the use of this website, are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules.
Changes to these terms
We may update this page as the website changes. The line at the top of this page identifies the current version, and using the site after a change means accepting the updated terms.
